Get over the thought that you represent India
Is this what you read into my 'India shining through sincere efforts of some people' line?
I'm glad at least you read so much. Here I'm trying to convince you that you also represent India, you ask me to stop thinking I represent India. We all represent India (in what ever minuscule way it may be) so we need to get serious about it.That's what this whole thread is about.Don't run to Wiki now

but lets see how far you go to discredit someone
On one hand you say these are misdeeds ,when attributed to someone it amounts to discrediting them(Again I'm glad you didn't say I or some one I know have committed these deeds and trying to push on your beloved politician...oh wait you are not batting for anyone right?)

And that is bad because ....... Oh well

and then you wonder if it is bad.Talk of ambivalence. This line shows not just your ambivalence but much more. You find nothing wrong in lying to the state. That cool uh?

This speaks volumes about your attitude and it's highly unnecessary for me to comment further.
    Generally speaking :
There is huge difference between a guy who thinks of his house as a guest house or a Hotel and a guy who thinks of his house as his home.

    Read this memo:

    http://bibdaily.com/pdfs/6-21-07%20AILA%20memo%20to%20Atyes%20&%20Neufeld.pdf

USCIS has indeed broken the law by doing what it did this month.

It has gone against what they used to do in the past, and they have not published this new policy in a place where stakeholders have a say (or atleast get to know in advance that the policy is changing). Valid complaints. But I dont think AILA is saying they broke the law. And thats scary.

:DI just got home from work and logged in and I thought I was dreaming !!!!!
My priority date is June 2003!!!!! I already have approved petition and AOS. When should I be expeting my GC in the mail considering no need to wait for FBI check any more ?

Hold your horses, brother. Remember that the official position of USCIS now is: "Oh we got so many applications last June-August, that it will be by the end of 2010 when maybe we will return to processing times we had before last summer". So now even with PD current I don't even know anymore when we actually will get it. Also remember that there are rumors they threw people onto processing citizenship applications because that issue got some public visibility. Guess from where they took thos adjudicators. You are right - from 485 processing.

    Please see my inline comment.

    SROYC,

Can you give me USCIS or any other authentic Doc/link which states ICMP share is 7% of 28.6% ? In years I have not found such doc. Therefore, assuming USCIS works fairly :D I had to divide 28.6% by 5 - equal share for each country within particular category.

Yes, there are many other factors we will have to factor in like incoming flow of applications, swith over count, spillover at the end of the year.

That is one way to look at things. The important thing is, whether the Judge looks at the situation the same way. It will be tough job to convince the Judge. If you seek legal opinion from a lawyer, lawyers mostly tend to say that you have a case expecting that that lawyer will be the one filing the lawsuit (i.e. making the money). So be careful with the idea and advise from a lawyer.

And more importantly, even if 'we have a case', do we have folks who are willing to be plaintiff in this lawsuit. Are you or Googler or chandu (because he replied to my earlier posts suggesting that we will find someone to lead) willing to be the plaintiff, or are you encouraging others (putting the gun on other's shoulder to fire) to be the plaintiff. If you see that there is chance/value in filing lawsuit, why don't you decide to be the plaintiff? Either way, if you are a plaintiff or if you know someone who wants to be one, why don't you take this to IV team.

Say we have a case, then to go to the next step we need -

1.) Someone willing to take the initiative/lead
    2.) Plaintiff
    3.) Resources
4.) There maybe more that I am not able to think at this time, because I no experience of filing class action lawsuit.

How to find what we need to file lawsuit -

For (1.), I suggest someone willing to give out his/her name as plaintiff should contact IV. I saw that folks are discussing this on too, but that site is not a non-profit. That site is owned by some guy who is earning good money of off the ads on his site. He won't spend resources to file for lawsuit although he has made good money off of the woes of others tracking their green card case status. So the only viable option is to get IV involved.

For (2.), if you want to see this through, then, at least one of around 180 folks who voted for filing lawsuit should be willing to be the plaintiff. If not, then someone needs to make phone calls to find a possible plaintiff.

For (3.), as mentioned above, I don't know of any one organized effort other than IV to lead such an effort of a lawsuit.

Sanju, while I commend the thought you have put into this, note that the thinking on this is at a VERY VERY VERY preliminary stage. In real life class action lawsuits, named plaintiffs are chosen based on how well they fit the argument in the case, not the other way round. As I said upthread, all those who want decisions, deals, money etc RIGHT NOW are being pretty unrealistic -- probably just because of unfamiliarity with the progress of cases like this. I know people want to be reassured that there is NO risk of losing, every decision node is mapped out, responsibility assigned, but if that is what anyone is thinking they have to rejigger their thinking. ;-)

If I fit the argument that is eventually made, I'd be more than happy to be a named plaintiff. I also have no problem ponying up a significant amount of money once I'm convinced about the legal argument and the attorney in question.

Good idea. But I am going to TSC.

This is what I'm doing. I'm flying to Nebraska service center friday night. Will put my shelter in front on PO box and will remain there until Monday morning. Once the USCIS guy comes up to pick up the mails, I'm just going to hand deliver my paper before he even opens his mail box.

    Want to join me ;)

If we those who have worked here, paid taxes , abided the law, followed the law of land once we return from India many of us have been questioned. Though as per us nothing might have changed like employer, salary, position, residential address etc etc... still many of our friends are detainted and asked to proved documental proof....{If we who have stayed here for years are detained} then why not SRK or any other person.....

After staying here for 9 years, I was detained in 2007 for 1 hour for questioning.....that way US has more proof about me for past 9 years then SRK or any other Indian bollywood stars....

I really don't see how removing the per country ceilings alone without increasing the anual quota will help the entire comminity. If you do that alone all it will do is make the date retrogressed for all the countries even further. So where's the gain?
Getting the anual quota increased, not counting dependents in the quota and recapturing visas from passed years will help EVERYBODY.

If people want to think that something petty as removing the per country quota is going to solve all our problms then all the best (and God bless us all) !

PS - Pardon me if this sounds harsh but this is how I see it.

We need to understand that the basic premise of the removing the per country limit uses the assumption that there is enough visa for all of us. But sadly this is not true. We have ask for increasing the GC limit from 140000 to xyz. The last increase was in 1990 which was after 14 years. Now 18 years have passed and there is no change in that direction.

Increasing limit cannot be fought in the court. It requires changes in law. Removing dependents from EB based GC consumption also cannot be decided in court. But removing per country limit for EB/GC can be decided in court. Just because we are fighting for one does not mean we are ignoring other agendas of IV.

Does anybody know how many EB2-I and EB2-ROW PERMs were processed for 2006, 2007 and 2008? Once we know these numbers it will be easy to predict EB2-I movement as all of the spillover numbers will be used primarily by EB2 India.

PlainSpeak - instead of spending so much time on responding to everyone's criticism of you, why dont you go ahead and detail out the "how" of "what" you think IV should do.

Maybe there is a gap in the understanding of all the posters here in terms of "how" all what you have said will pan out.

Please be specific around who, when, to whom and using what means can the "what" of your proposition be accomplished. And while you are at it, it will also be useful to lay out how and which of the activities you could personally be of help (by devoting time/ money/ energy/ All/ Some Combination).

For all you know, it might open the eyes of a lot of people here.

My friend if all you abusive people wil stop criticing and providing abusive comments then we can start on teh actual work. I am not going to jump through hoops just because you have asked me to. First let me see whether the attitude of the people out here (Yes i mean you abusive people) will change becasue without doing that if i start on the implementing what i am talkinbg about all you guys will do is sabotage the talk

Maybe there is a gap in the understanding of all the posters here in terms of "how" all what you have said will pan out.
This is a forum right. How what where and when will have to be discussed and worked out (And yes i do not want any credit for it so name it GCHope2001's grand idea for all i care), but ....
If everyone is against the plan from the start (and being vocally abusive about it) how do you think anything will move forward on this

Please be specific around who, when, to whom and using what means can the "what" of your proposition be accomplished. And while you are at it, it will also be useful to lay out how and which of the activities you could personally be of help (by devoting time/ money/ energy/ All/ Some Combination).
Only if i think at least 25 % of all you senior abusive member even agree in principle with what is being proposed. Heck my idea is for releif for EB retrogressed persons and all i get from all you senior memebers and donors is oh he is lazy skill less eb3 and he is doing it to get his creen card and other comments and everyone is all about lets bash this person and oh wow she is a gal so lets do some crude women joke (There was a guy ealier who talked about proper up bringing. I do not see you here any more)

And yes my friends please use this as an oppurtunity to start off a new discussion about how he needs help. My friends everyone needs help. Even you. Even core

For all you know, it might open the eyes of a lot of people here. How can some one open up the eyes of the people who bent on keeping it closed. First is there a concensus on this. I do not see any. Any you want me to stand up ubn front of all these people batying for blood and give a detail idea of ho wi wil accomplish. I do not talk to people like that why would i talk about any plan to those who do not agree with even discussing it forget about implementing it

To me: sinhalas and tamils look very similar.
This guy even goes further and says they are one and the same.

    http://www.geocities.com/nallathambi_thevar/TamilSangam_Mauryas.htm

The present day Sinhala-Tamil conflict though originally a conflict between followers of Hinduism and the neo converts to Buddhism had morphed into a conflict between casteist Tamil Hindus and Tamil followers of ‘Organized Buddhism’ to a conflict between Tamils and Sinhala with the converted Buddhist shifting there allegiance to Pali/Sinhala.Organized Buddhism succeeded in separating Elangai from Tamilakam with its own language of Pali/Sinhala.

villamonte6100 there was a thread some time back about people considering going to law school and becoming their own lawyers. What I took out of it was that its not that easy. Besides going to school, you have to pass some tough state exams. I am quite happy with my lawyer. I paid some dough but its much cheaper than going to law school, and saves me time and headache.

Going to law school is not for everyone, definitely not for me (fat books scares me ). I like the suggestion by garybanz about getting a qualified opinion. Just so that we know.

Well there is no reason to say person who started this thread is buying labor.

Can you prove that you got an offer for substitute labor and you rejected it?

    :o

If you have a valid point, why don't you start a new thread where people can report those users who post question on substitution. We will see if that forum gets popular.

It is distracting to people who came to look for answers based on title of this post. Good luck at mud slinging!!

......because you are using labor substitution.

At this time nobody can do anything legally against people who are using labor substitution and employers who are secretly selling labor substitution.

This substitution is increasing backlogs, is unfair to people waiting in line, encourages employer exploitation since they use it as an incentive to woo employees and then exploit them, 'selling' is illegal but one must complain against the employer and the employee for DOL to act.

Lawyers are part of this scam. I have read in some posts that even AILA opposed when labor substitution was being ended. It is a lost business opportunity for their lawyer members!!

I have pointed several labor substitution members on the forums in the past. some of them were never found on the forum since they feared being caught. They must have changed their ID or ran away. So until a law is passed for banning it, such 'trade' that hurts our interests will continue.

Good that you guys are only buying labor certifications. There is no 'legal' process to buy greencards directly from employers yet!!
